Many pundits and others are saying that Bayern should have been disqualified in the BC Classic.
Personally, I do not think so. There are two reasons for this. First, Bayern's actions did come at the start of the race and my understanding of the rules is that you cannot penalize a horse for what happens shortly after the break because it is impossible to control when you are dealing with thoroughbreds UNLESS you can prove that the jockey acted intentionally which is impossible to prove unless you have audio of the jockey or trainer giving such instructions or confessing. Plenty of incidents happen at the start of a race - Lookin at Lucky was hurt at the start of the Derby.
The second reason that Bayern should not have been disqualified was because his actions did not compromise Shared Belief's chances as Mike Smith indicated. I believe Shared Belief's chances were compromised in the stretch passing the grandstand for the first time when Smith had to pull up Shared Belief after being checked hard by the massive Toast of New York. Thus, if Bayern comes down so does Toast of New York in my opinion which would have meant putting up the 3rd and not 2nd place horse which would have created pandemonium and threatened the integrity of the sport more than leaving Bayern up did. .
Now, others suggest that the outcome of the race was changed at the break because VE Day, Tonalist and Moreno were compromised. Well, as noted, other horses have been compromised at the start of races without a foul being entered. Its the nature of horse racing.

Shared Belief clearly had trouble (as did Moreno) during the race, although I think it's debatable that the incident at the start alone actually cost him the race. I agree the trouble going past the stands first time was significant, plus SB got bumped on the back side. It was a rough trip all around for him, which is a shame since he didn't really get fair shake and this was not a gauge of his true ability.
I have two questions:
If the race had been a 6F sprint do you think Bayern would have been DQed?
If the race happened to be a stakes race on an average weekend (i.e. not the BC) do you think he would have been DQed?
If the answer is yes to either, then he should have been DQed on Saturday.
IMO he should have come down, but I am absolutely not surprised that he didn't given the prominence of the race and some of the other factors involved.
